The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 307, 324, 504, 506/34 of the Indian Penal Code.
Allegation against this petitioner is of commission of assault by tangi (axe) on the head of husband of informant. It is submitted on behalf of petitioner that though, there is allegation of assault by tangi, but there is no injury report on record. Other similarly situated co-accused persons have already been granted anticipatory bail by the learned Court below itself. It is further submitted that both parties are next door neighbours and due to petty dispute, a simple scuffle took place and taking advantage of this, the present false and concocted case has been lodged against petitioner and his family members. Petitioner has got clean antecedent.
Patna High Court CR. MISC. No.1082 of 2023(5) dt.04-07-2023 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Munger in connection with Laraiya Tand P.S.
