JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 28-04-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Sakra P.S. (Bariyarpur O.P.) Case No. 341 of 2022, registered for offence punishable under sections 147, 149, 341, 323, 354, 379, 307, 504 and 506 of the Indian Penal Code. As per allegation, the petitioner has badly assaulted the members of the informant side and made them injured. The allegation against the petitioner is also of outraging the modesty of the daughter of the informant by tearing her T-shirt. The learned counsel for the petitioner has submitted that the petitioner is innocent. There is case and counter case. Both the sides have suffered injuries and some other co-accused

Patna High Court CR. MISC. No.1649 of 2023(2) dt.28-04-2023 2/3 persons have been granted anticipatory bail. The petitioner is a person of clean antecedent and he is under custody since 19.09.2022.

On the other hand, the learned counsel for the informant has opposed the prayer for bail and submitted that the petitioner and other accused persons badly assaulted the prosecution side and the specific allegation against the petitioner is that he outraged the modesty of the daughter of the informant, as such, he does not deserve the privileges for bail. Considering the above-mentioned facts and circumstances as well as clean antecedent of the petitioner, let him be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XII, (East) Muzaffarpur in connection with Sakra P.S. (Bariyarpur O.P.) Case No.341 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have
