JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Paroo P.S. Case No. 181 of 2019, registered for the offences punishable under Sections 147, 341, 323, 307, 504, 506 of the Indian Penal Code.

As per F.I.R the petitioners and other co-accused persons have assaulted the informant and other three persons causing injuries to them.

Submission of the learned counsel for the petitioners is that there is dispute with respect to homestead land and no specific allegation has been attributed against them. There is case and counter case between the parties.

Patna High Court CR. MISC. No.68897 of 2019(2) dt.18-11-2019 2/2 On the other hand, learned A.P.P has opposed the prayer of bail on the ground that one of the injuries caused by them found to be grievous in nature.

Having heard both sides, considering the above submission, this application allowed. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) each with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate, 3rd (West) Muzaffarpur, in connection with Paroo P.S. Case No.-181 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
