JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-08-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 21.7.2017 passed in Cr.Misc.No. 33148 of 2017.
Submission of learned counsel for the petitioner is that he has been implicated in this case only on the basis of confessional statement of co-accused only because of the fact that he has criminal antecedents, his prayer for bail was earlier rejected. However, other co-accused persons have been granted bail vide order dated 4.8.2017 passed in Cr.Misc.No. 32152 of 2017, vide order dated 25.4.2017 passed in Cr.Misc.No. 11120 of 2017 and vide order dated 27.7.2017 passed in Cr.Misc.No. 27955 of 2017 (Annexure-3 series). Further submission is that petitioner is in custody for about 20 months.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-I, West Champaran, Bettiah, in connection with Sessions Trial No. 415 of 2017, arising out of Bettiah Muffasil P.S.Case No. 238 of 2016, subject to the conditions that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and petitioner has to appear before the trial court as and when required, otherwise his bail bond shall be cancelled.
