The petitioner seeks bail in Katihar Town P.S. Case No.144/2016, registered under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the prayer for bail of the petitioner was earlier rejected vide order dated 30.08.2017 passed in Cr. Misc. No.34178 of 2017 with direction to the trial court to conclude the trial within six months but even after lapse of more than one year, the trial has not yet been started. The petitioner is in jail since 14.04.2016. The petitioner remained in jail for more than two years and five months.

Taking into consideration the fact aforesaid, the

Patna High Court Cr.Misc. No.50218 of 2018 (2) dt.26-09-2018 2/2 petitioner above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar, in connection with Katihar Town P.S. Case No.144 of 2016, subject to the condition that one of the bailors will be close relative of the petitioner having substantial immovable property within the territorial jurisdiction of the court.
