This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 341, 323, 354(B), 354(C) and 34 of the Indian Penal Code and Sections 8, 13, 14, 15 and 18 of the POCSO Act, registered in connection with Shrinagar P.S.Case No. 79 of 2022.
The allegation against the petitioner is that he along with co-accused Dilip Yadav outraged the modesty of the daughter of the informant and with the help of another accused person made the video of the occurrence.
The learned counsel for the petitioner has submitted that on similarly situated footing, co-accused Dilip Yadav has
Patna High Court CR. MISC. No.12358 of 2023(2) dt.11-05-2023 2/2 been granted bail by a coordinate Bench of this Court in Cr.Misc.No.2330 of 2023 and the petitioner is in custody since 22.09.2022.
Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO-cum-ADJ-Vith, Bettiah, West Champaran in connection with Shrinagar P.S.Case No. 79 of 2022, subject to the following conditions:-
1. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
2. If the petitioner is found involved in future in similar type of offence, his bail bond shall stand cancelled.
