Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 427, 447, 385, 386, 120B, 147, 148 and 149 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioner No. 1 has antecedent of one case and petitioner No. 2 is a person with clean antecedent. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that the same does not inspire confidence and for dispute relating to land, the instant FIR has been instituted with an allegation that the accused persons including the petitioners came and demanded extortion of Rs. 10 lakh from the informant on the ground that he will not be allowed to construct the school on the land in question,

Patna High Court CR. MISC. No.81382 of 2023(3) dt.25-06-2024 2/2 on which the petitioner paid an amount of Rs. 3 lakh by way of extortion.

The learned counsel for the petitioner submits that informant intends to capture the land of the petitioner as the land on which the informant is trying to construct the school belongs to the petitioner, as would manifest from Annexure-2 to the anticipatory bail application.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Jamui P.S. Case No. 492 of 2023 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
