20-09-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner, in the present case, is seeking regular bail in connection with Dharahara P.S. Case No. 52/2018 registered for the offence punishable under Sections 414/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that according to the First Information Report the petitioner was one of the persons riding on the motorcycle in question when it was intercepted by police. The allegation is that this petitioner fled away from the place of occurrence. It is alleged that the co-accused Rohit Kumar disclosed that the motorcycle in question was brought by the cousin brother of this

Patna High Court Cr.Misc. No.51913 of 2018 (2) dt.20-09-2018 petitioner. Learned counsel submits that this petitioner has got no criminal antecedent and he was neither arrested on the spot nor any incriminating material has been recovered from his possession. There is no complaint regarding the theft of motorcycle.

Learned Additional Public Prosecutor representing the State has opposes the prayer for bail of the petitioner.

Considering the facts and circumstances of the case wherein the petitioner has not been arrested on the spot and there is no criminal history of this petitioner, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. - 1st, Munger, in connection with Dharahara P.S.
