Petitioners pray for bail in connection with Imamganj P.S.Case No. 11 of 2018 and in POCSO Case No. 23 of 2018, registered for the offences punishable under Sections 376(2g)/34 of the Indian Penal Code and Section 5 of POCSO Act. Allegation against the petitioners is of committing rape upon the minor daughter of the informant.
Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and they are in custody for more than six months.
Heard learned APP also.
Having heard both sides and in view of allegation, I am not inclined to grant bail to the petitioners.
Patna High Court Cr.Misc. No.55040 of 2018 (2) dt.10-10-2018 2/2 Accordingly, this application is dismissed.
