The petitioner seeks bail in a case registered under Section 392 of the Indian Penal Code.

Allegation is that three unknown miscreants on the point of knife took away two mobiles and a black bag containing Rs.1000/- and other essential documents from the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.09.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come in this case on

Patna High Court CR. MISC. No.73378 of 2019(2) dt.19-11-2019 2/2 confessional statement of co-accused. One black bag is said to have been recovered, which is alleged to have been looted by the miscreants. Said bag has not been put on T.I.P. The petitioner has also not been put on T.I.P. to ascertain his participation in the alleged occurrence.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with G.B. Nagar P.S. case No.238 of 2019.
