2. The petitioner apprehends his arrest in connection with Khajekalan P.S. Case No. 170/2023 dated 07.05.2023 registered for the offence punishable under Section 498(A) of the Indian Penal Code.

3. The main submissions advanced by learned counsel appearing for the petitioner are that the petitioner is a 50 year old person and his marriage with the informant admittedly took place fourteen years ago and there is one daughter of the petitioner who is presently aged eleven years, in fact the informant got a government job at Magadh Medical College,

No.83587 of 2024(2) dt.11-12-2024 2/2 Gaya and thereafter, she started residing separately from this petitioner and suddenly, on 06.05.2023, she returned back on her own and demanded her claim in the house of the petitioner and she filed a partition suit in respect of the property of the petitioner before the institution of the present FIR and these facts are sufficient to show that the FIR of the present matter has been lodged with malicious intention.

4. Learned APP appearing for the State has opposed the prayer for bail.

5. Having considered the submissions made by the petitioner's counsel, this Court finds the petitioner's prayer to be fit for accepting his anticipatory bail. Accordingly, let the petitioner named-above, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Khajekalan P.S. Case No. 170/2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Shailendra Singh, J) annu/- U T
