The petitioner is apprehending her arrest in a case registered under Sections 409, 420, 120B, 34 of the Indian Penal Code.

The prosecution case, in brief, is that irregularities were committed under the Govt.

scheme meant for Indira Awas/Pradhanmantri Awas Yojana under Kumarkhand Block. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused in this case due to mistake of fact. On the necessary verification in respect of documents which

Patna High Court Cr.Misc. No.52427 of 2018 (2) dt.10-09-2018 are made by the other co-accused persons, the petitioner is said to have acted in casual manner. It is further submitted that the petitioner is ready to deposit an amount of Rs. 1,00,000/- in the court below which shall be subject to final outcome of the case. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to deposit an amount of Rs. 1,00,000/- in the court below which shall be subject to final outcome of the case and after depositing the said amount, the petitioner, in the event of arrest/surrender before the learned court below within a period of six weeks from today, will be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Kumarkhand P.S. Case No. 124 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
