The petitioner, in the present case, is seeking regular bail in connection with Mashrak P.S. Case No.103 of 2018, registered for offences alleged under Sections 399, 402, 420, 467, 468 and 471 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.
Learned counsel for the petitioner submits that the allegation against the petitioner is that he was one among the three accused persons who were arrested by police on chase and in course of search one country made pistol with two live cartridges were recovered from the possession of the petitioner. Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.51794 of 2018 (2) dt.20-09-2018 petitioner is in custody since 14.04.2018 and one of the coaccused who was arrested along with the petitioner has been granted privilege of regular bail by a learned coordinate Bench of this Court in Cr.Misc.No.35839 of 2018 vide order dated 28.06.2018. It is also submitted that though there is one case against the petitioner as stated in paragraph 3, but it is for minor offence and he is on bail in the said case.
In the given facts and circumstances where the petitioner has remained in custody for a considerable period and one of the co-accused has been granted privilege of regular bail, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VI, Saran at Chapra, District-Saran in connection with Mashrakh P.S. Case No. 103 of 2018, subject to the conditions U/S 437(3) Cr.P.C.
