The petitioner has filed the instant application for grant of anticipatory bail apprehending his arrest in a case registered for the offence under sections 188, 353/34 of the Indian Penal Code, Section 9 of Loud Speaker Act and Section 27 of the Arms Act. Allegation as per the FIR, is that the petitioner and one another accused persons are said to have been dancing on the stage with the dancers, variously armed and playing the DJ. It is submitted on behalf of the petitioner that the allegation as levelled in the FIR are false and concocted. It is further submitted that the case of the petitioner stands on similar footing to the other accused persons who have been enlarged on bail by order dated 27.11.2019 in Cr. Misc. No.76778 of 2019 and order dated 02.12.2019 in Cr. Misc. No.77899 of 2019. It is further submitted
Patna High Court CR. MISC. No.82200 of 2019(2) dt.11-12-2019 2/2 that the petitioner has no criminal antecedent. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the nature of the allegation and the petitioner having no criminal antecedent, the court is inclined to enlarge the petitioner on bail. The petitioner above named, in the event of his arrest or surrender in the court below within a period of six weeks from today in connection with Kuchaikote P.S. Case No.282 of 2019 is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM,VII, Gopalganj, subject to the conditions as laid down in section 438(2) of Criminal Procedure Code.
