2. In this case, the petitioner is seeking regular bail in connection with Amnour P.S. Case No. 170 of 2024, registered for the offences punishable under Sections 399, 402, 120(B) of IPC and Section 25(1-b)a, 26 and 35 of the Arms Act.
3. Prosecution case in short is that on the tip off, the informant along with police personnel reached at the place of occurrence where seeing the police, the miscreants on two motorcycles started fleeing away but on chase, three of them were apprehended.
4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. Nothing has been recovered from the conscious possession of the petitioner. Petitioner is not named in the FIR
Patna High Court CR. MISC. No.80603 of 2024(2) dt.14-02-2025 2/2 and his name transpired on the basis of confessional statement of apprehended co-accused. He was not arrested on the spot. It has also been submitted that the case of the petitioner is on better footing than that of co-accused, Pintu Kumar who has been arrested at the spot and has been granted bail by this Court vide order dated 10.09.2024 passed in Cr. Misc. No. 63291 of 2024. The petitioner has four criminal antecedent. The petitioner is under custody since 26.06.2024.
5. On the other hand, the learned APP for the State has opposed the prayer for bail.
6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- VIII, Saran at Chapra in connection with Amnour P.S. Case No. 170 of 2024, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
