====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR SINHA ORAL ORDER 12-11-2025 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the respondent-State.

2. With consent of the parties, the present writ application is being disposed of at this stage itself.

3. The petitioner has prayed for grant of following relief :- "1. (i) For issuance of appropriate writ commanding the respondent to post the petitioner within the District Patna as per the provisional appointment letter issued on 20.11.2024 in terms of Bihar School Exclusive Teachers Rule 2023 in any Girls High School. (ii) For issuance of appropriate writ commanding the respondent to consider the case of the petitioner for inter-district transfer according to amending rule 2024 as well as the policy decision of

Patna High Court CWJC No.18039 of 2025(2) dt.12-11-2025 2/3 transfer issued by Department of Educaiton, Govt. of Bihar contained in Annexure-9."

4. Learned counsel for the petitioner submits that for the aforesaid relief claimed in the present writ application, the petitioner is prepared to file a detail representation before the Addl. Chief Secretary, Department of Education, Govt. of Bihar, (respondent No.2) and prays that appropriate direction be issued to respondent No.2 to decide the representation on merit after giving an opportunity of hearing to the petitioner within a time frame.

5. To the aforesaid submissions made by learned counsel for the petitioner, learned counsel appearing for respondent-State does not have any objection.

6. Considering the limited nature of prayer being made by learned counsel for the petitioner, this writ application is disposed of granting liberty to the petitioner to file a detail representation before the Addl. Chief Secretary, Department of Education, Govt. of Bihar, (respondent No.2) within one month from today and if such a representation is filed, the respondent No.2, i.e., Addl. Chief Secretary, Department of Education, Govt. of Bihar, shall decide the said representation on merit after giving an opportunity of hearing to the petitioner by passing a reasoned and speaking order.

7. The entire exercise must be completed by respondent No.2, Addl. Chief Secretary, Department of Education, Govt. of Bihar within a period of four months from the date of filing of the representation by the petitioner.

8. With the aforesaid observation/direction and liberty granted, the present writ application stands disposed of.

9. All pending I.A.s, if any, is deemed to have been disposed of.
