Allegation against the petitioner is of assault by rod and earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 30.1.2017 passed in Cr. Misc. No.51599 of 2016 and order dated 11.10.2017 passed in Cr. Misc. No.47444 of 2017.

Submission of the learned counsel for the petitioner is that there is general allegation against the petitioner and he is in custody for more than two years and not a single witness has been examined in this case and the main allegation is against Rajendra Yadav.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

Patna High Court Cr.Misc. No.51313 of 2018 (2) dt.05-09-2018 2/2 circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.1st, Madhepura in connection with S.Tr. No.104 of 2017/CIS No.104 of 2017 arising out of Madhepura (Ghailardh) P.S.Case No.501 of 2016. With the aforesaid observation, this application is allowed.
