The petitioner seeks bail in a case registered for the offence punishable under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-B)a, 26 of the Arms Act. Petitioner along with other accused persons are said to have assembled at the place of occurrence to commit some crime and petitioner was apprehended along with loaded country made pistol and a live cartridge.

It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He was not apprehended at the spot rather the police apprehended him from his house and falsely remanded him in

Patna High Court CR. MISC. No.76371 of 2019(2) dt.12-12-2019 2/2 two other cases, which has been lodged against the petitioner planting the recovery of the aforesaid article from his possession. Other co-accused namely Situ Kumar has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 13.09.2019 passed in Cr. Misc. No. 61962/2019. The petitioner has been languishing in custody since 26.06.2019. Learned APP for the State opposed the bail petition.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Danapur in connection with Rupaspur P.S. Case No.289 of 2019.
