The petitioner seeks bail in connection with Teghra P.S. Case No. 244 of 2018 registered for the offence punishable under Section 30 (a) of Bihar Prohibition Excise Act, 2016. 137.7 lts. of foreign liquor is said to have been recovered from the house of accused Anjani Rai and petitioner and other accused are said to have fled away from the aforesaid place.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has no concern either with the seized liquor or with the place of recovery or with any
Patna High Court Cr.Misc. No.52006 of 2018(2) dt.24-08-2018 2/2 trade of liquor. He has been falsely implicated in this case at the instance of his enemy due to dirty village politics. The identity and genuineness of the source of information has not been mentioned in the written report. He was not apprehended on the spot. Though, two more cases under Excise Act have been lodged against the petitioner, but he is on bail in the said cases. He has been languishing in custody since 18.07.2018. Similarly situated co-accused, namely, Madhu Kumar @ Madhu Thakur and Abhay Kumar @ Abhay Thakur have been enlarged on bail by a co-ordinate Bench of this Court vide order dated 10.08.2018 and 16.08.2018 passed in Cr. Misc. no. 49463 of 2018 and 50002 of 2018 respectively.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Begusarai in connection with Teghra P.S. Case No. 244 of 2018.
