The petitioner seeks bail in connection with Bihariganj P.S. Case No.362 of 2017 registered under Sections 406 and 420/34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner surfaced in the confessional statement of the co-accused, Paplesh Kumar Yadav, having the hand of the petitioner in the present case. Further submission is that the co-accused Paplesh Kumar Yadav has already been granted bail by a Bench of this Court vide order dated 04.12.2019 passed in Criminal Misc. No.79177 of
Patna High Court CR. MISC. No.68209 of 2019(3) dt.18-02-2020 2/2 2019. In the present case, the petitioner is in custody since 15.06.2019 and, on investigation, the police has already submitted the charge-sheet against the petitioner. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, First Class, Udakishunganj at Madhepura, in connection with Bihariganj P.S. Case No.362 of 2017.
