Petitioners apprehend arrest in connection with Piar P.S. Case No. 231 of 2022 registered for the offences under Sections 272, 273 and 34 of the Indian Penal Code and Section 30(a) and 34 of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the instant case. Further submission is that the name of the petitioner has been transpired only on the basis of confessional statement of co-accused namely Mithlesh Kumar and nothing has been recovered from the conscious possession of the petitioner. Petitioner has no criminal antecedent. Considering the facts and circumstances of the case
Patna High Court CR. MISC. No.1241 of 2023(2) dt.17-02-2023 2/2 and the submissions advanced on behalf of the parties, the petitioner, above named is directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Exclusive Special Judge Excise Court No.-II, Muzaffarpur in connection with Piar P.S. Case No. 231 of 2022 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
