The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 341, 323, 379, 307 and 504/34 of the Indian Penal Code and Section 27 of the Arms Act pending in the learned court below. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He fairly submits that there is allegation against the petitioner to fire upon the informant and injured person has sustained simple fracture. He further submits that petitioner had not intention to kill the victim. He further submits that petitioner has got no criminal antecedent as stated in para-3 of the bail application.

Patna High Court CR. MISC. No.330 of 2023(2) dt.21-03-2023 2/2 Per contra, learned APP for the State vehemently opposing the bail application and submitted that the petitioner is the main assailant in the present case. Hence, he does not deserve anticipatory bail.

Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail in connection with Sultanganj P.S. Case No. 305/2022. Accordingly, his prayer for anticipatory bail is hereby rejected.
