JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-03-2020 The petitioner seeks bail in connection with Madhaurah P.S. Case No. 517 of 2019 dated 27.07.2019 instituted for the offences under Sections 467, 468, 469, 471 and 414 of the Indian Penal Code in which he is in custody since 27.07.2019.

It appears that on secret information that stolen motorcycles have been kept in his house by one Arbind Kumar Singh, the house of Arbind Kumar Singh was raided and from there a stolen motorcycle was recovered. Aforesaid Arbind Kumar Singh named other accomplices also viz. Rohit Kumar and Sonu Kumar. From the house of Rohit Kumar, one stolen motorcycle was recovered and aforesaid Rohit Kumar disclosed that the motorcycle was purchased from the petitioner. Learned counsel for the petitioner submits that the petitioner has not sold any vehicle to Rohit Kumar and at best, the case against the petitioner would only be on the basis of confession of a co-accused. There is no recovery of any stolen vehicle from the possession of the petitioner. The person who has named the petitioner as the vendor of the stolen motorcycle viz. Rohit Kumar has been granted bail by a bench of this Court. Considering the aforestated facts and also taking into account the clean antecedents of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Madhaurah P.S. Case No. 517 of 2019.
