The petitioner seeks bail in connection with a case registered for the offence punishable u/s 386, 387, 307, 120B, 504, 506/34 of IPC and 27 of Arms Act.

Allegedly, the petitioner is said to have previously threatened one Bachcha Singh (employer of the informant) on his Whatsapp and demanded extortion money. As per the prosecution case, on the alleged date of occurrence, four unknown miscreants fired with pistol on the informant.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence as alleged in the FIR. No offence as alleged has ever taken place. He has been falsely implicated in this case due to ulterior motive. No incriminating article has been recovered from the conscious

Patna High Court CR. MISC. No.84269 of 2024(2) dt.24-01-2025 2/2 physical possession of the petitioner. There is no specific overt act against the petitioner. The petitioner has criminal antecedent as mentioned in para 3 of the bail application and has been languishing in custody since 01.05.2024.

This is the second attempt of the petitioner for grant of regular bail of the petitioner. Earlier, the petitioner had filed Cr. Misc. No. 48839 of 2024 for grant of regular bail of the petitioner but vide order dated 07.08.2024, the same was dismissed with a liberty to renew the prayer for regular bail after framing of charge. It is submitted that charge has been framed against the petitioner. 6.

Learned APP for the State opposed the prayer for bail. 7.

Considering the facts and circumstances of this case, period of custody of the petitioner and since charge has been framed, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/the Successor Court, in connection with Daraunda P.S. Case No. 218 of 2023, with STR No. 391 of 2024. (Anjani Kumar Sharan, J) priyanka/- U T
