JUSTICE SANJAY PRIYA ORAL ORDER 27-09-2018 Supplementary affidavit has been filed on behalf of the petitioner. Let it be kept on the record. Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sahebpur Kamal P.S. Case No. 61 of 2018 instituted for the offence under Section 394 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner has been falsely implicated in the instant case. He is not named in the written report. The petitioner has been arrested merely on suspicion. Counsel for the petitioner has pointed out seizure list which has been enclosed as Annexure-2 wherein it is mentioned that vehicle was recovered in front of Hotel New Classic situated at NH-28. There is no mention that the aforesaid vehicle was

Petitioner is said to be in custody since 16.03.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Begusarai, in connection with Sahebpur Kamal P.S.
