The petitioner, who is in custody, seeks bail in connection with Bakhari P.S. Case No. 181 of 2018 registered for the offence punishable under Sections 324, 302, 201, 34 of the Indian Penal Code and Section 27 of Arms Act. Informant has alleged in her written complaint that on 05.06.2018 at 10.00 AM she came to know that unknown dead body was kept at the police station, when she reached there, she came to know that dead body has been sent for postmortem to Begusarai and when she went at Begusarai then she saw that her son sustained bullet injuries on his chest and arms and there were numbers of injuries of knife found on his
Patna High Court Cr.Misc. No.52096 of 2018(2) dt.04-10-2018 2/2 body. She suspects that due to previous land dispute her neighbours and his associates including petitioner have killed his son.
It has been submitted on behalf of the petitioner that on reading of the FIR it transpires that the informant has land dispute with his neighbours namely Sito Rai, Chhabu Rai, Panchu Rai. Informant has no dispute with the petitioner. He has been implicated in this case only on suspicion that he is associated with her neighbour who have land dispute with informant. Petitioner is in custody since 07.06.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- III, Begusarai, in connection with Bakhari P.S.
