The petitioner seeks bail in a case instituted for the offences under Sections 504, 307/34 of the Indian Penal Code and 27 of the Arms Act.
The prosecution case in short is that the accused persons shot fire at the informant due to which he received fire arm injury.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.8.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. From perusal of the F.I.R, it is evident that the two parties entered into hot exchange of words
Patna High Court CR. MISC. No.69014 of 2019(2) dt.04-11-2019 2/2 and thereafter they fired at each other. In course of that, the informant is said to have sustained a fire arm injury on his thigh. General and omnibus allegation has been made against the petitioner. No specific injury is attributed against the petitioner. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Muffasil P.S.
