Petitioner apprehends arrest in a case registered for the offence punishable under sections 341, 342, 323, 354, 504, 506, 34 of the Indian Penal Code & 25 (1-b)a, 26, 35 of the Arms Act.

On the alleged date and time of occurrence all the F.I.R named accused persons including this petitioner entered the house of informant and assaulted his wife and his nephew. Petitioner and co-accused Jahangir Ansari fired in air to threaten the informant and his family but local people assembled there. Thereafter, all the accused persons fled away. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He further submits that the petitioner is seizure list witness

Patna High Court CR. MISC. No.7384 of 2023(2) dt.24-04-2023 2/2 of the present case instituted by Habib Ansari. The petitioner happens to be nephew (Bhanja) of the informant of Rudrapur P.S Case no. 70 of 2020. During course of investigation, the police in collusion with F.I.R named persons, made this petitioner accused in this case.

Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M, II, Jhanjharpur, District- Madhubani in connection with Rudrapur P.S. case no 70 of 2020, corresponding to G.R. no. 1257 of 2020 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
