JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-09-2018 This application has been filed for modification of the order dated 29.6.2018 passed in Cr.Misc.No. 38380 of 2018 by which conditional anticipatory bail was granted to the petitioner with direction that petitioner to surrender in the court below within a period of six weeks along with Bank Draft of Rs.1 lakh in favour of opposite party No.2 and thereafter he will be released on provisional bail for a period of five months and in the meantime rest amount of Rs. 5 lakhs will be deposited in five equal instalments and failure to deposit any of the instalments his bail bonds shall be cancelled.

Submission of learned counsel for the petitioner is that he may be permitted to deposit the amount to the court below instead of opposite party No.2 so that he may realize the same, otherwise

In the facts and circumstances, I am not inclined to interfere with the earlier order. However, further 15 days time is allowed to the petitioner to deposit the total due amount in court below and the said deposit will be subject to the result of the case. With the above observation, this application is disposed of.
