JUSTICE SHIVAJI PANDEY ORAL ORDER 16-12-2020 Heard learned counsel for the petitioners and learned counsel for the State through Video Conferencing. In this case, the petitioners are seeking anticipatory bail in connection with Arwal P.S. Case No. 140 of 2019 registered for offence punishable under sections 302, 201 and 34 of the Indian Penal Code.
The incident has taken place in the mid-night and the wife of the deceased was there and when the father of the deceased returned, found his son to be dead and made suspicion that the family member of the lady are really involved in commission of the death of his son. Investigation is carried out. The polite has investigated the matter but failed to collect the material against these petitioners. Paragraph 37 and 38 shows that the police has not submitted charge sheet against the present

Looking to the entirety of the matter, the petitioners above named in event of arrest or surrender before the court below with six weeks from today are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VI, Jehanabad in connection with Arwal P.S. Case No. 140 of 2019, subject to condition as laid down under section 438 (2) Cr.PC and further condition is that one of the bailors of the petitioners shall be a close relative. The petitioners will not induce any witness or tamper with the evidence. The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court. Further condition is that as and when the police would call the petitioners for the purpose of interrogation/investigation, they would present themselves for the aforesaid purpose. In case of failure, the prosecution will have liberty to file an application for cancellation of their bail and the court below will pass the order in accordance with law.
