Mr.Rajeev Nayan App 231 ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 19-06-2023 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners have prayed for regular bail in a case registered for the offence punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of Arms Act. As per prosecution case, police received information about some miscreants armed with lethal weapons making plan to commit dacoity and a raid was conducted whereupon the petitioners along with other co-accused persons apprehended and some country made loaded pistols with live cartridges were recovered from them.

Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely been implicated in

Patna High Court CR. MISC. No.2828 of 2023(3) dt.19-06-2023 2/2 this case on suspicion. The petitioners have no concern with the alleged recovery. It is further submitted that similarly situated other co-accused persons namely Ranjan Yadav and Pawan Yadav have already been granted bail by another co-ordinate Bench of this Court vide order dated 22.05.2023 passed in Cr. Misc. No. 21079 of 2023. Moreover, the petitioners are languishing in judicial custody since 19.08.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody of the petitioners, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Chausa P.S. Case No. 183 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Udakishunganj, Medhepura.
