JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-10-2018 Heard the parties. The petitioner seeks regular bail in connection with Sessions Trial No. 85 of 2017 arising out of Nawanagar P. S. Case No. 149 of 2016, registered for the office under Sections 302 and 201/34 of the Indian Penal Code.

Allegation against the petitioner, who happens to be wife of the deceased, is of causing the death of the deceased. Submission of the learned counsel for the petitioner is that though the name of the petitioner has not surfaced in the F.I.R. but later on the name of the petitioner transpired on the confession of co-accused and the petitioner is in custody since 26.12.2016. It is also submitted that four witnesses have been examined but they have not named the petitioner.

Patna High Court Cr.Misc. No.52256 of 2018 (2) dt.04-10-2018 2/2 Heard learned A.P.P. also who opposed the prayer for bail.

Having heard both sides and in view of the allegation and also on the ground that trial is going on and four witnesses have been examined out of seven witnesses, I am not inclined to grant bail to the petitioner. However, as the petitioner is in custody since 26.12.2016, the trial Court is directed to expedite the trial and try to conclude the same as soon as possible.
