JUSTICE SANJAY PRIYA ORAL ORDER 03-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Excise P.S. Case No. 989 of 2018 arising out of Ara Nawada P.S. Case No. 409 of 2018 instituted for the offence under Sections 25(1-b)a, 26, 35 of the Arms Act and Sections 30(a) of the Bihar Prohibition & Excise Act, 2016.
Counsel for the petitioner submits that petitioner has clean antecedent. He is in custody since 18.06.2018. From the seizure list it appears that one country made pistol loaded with three cartridges have been recovered from possession of the petitioner.
Counsel for the petitioner submits that petitioner was passing through from the place of occurrence with his car and has
Patna High Court Cr.Misc. No.53825 of 2018 (2) dt.03-10-2018 2/2 been implicated in this case.
It is mentioned in paragraph-3 of the bail petition that petitioner has no criminal antecedent.
Keeping in view the period spent by the petitioner in custody, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bhojpur, Ara, in connection with Excise P.S. Case No. 989 of 2018 arising out of Ara Nawada P.S. Case No. 409 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
Petitioner will file an affidavit that he will not indulge in such type of activity in future.
