This is an application for regular bail in connection with Garkha P.S. Case No. 249 of 2018 registered for the offences punishable under Sections 399, 402 and 414 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.
Informant is the police officer, who in his self statement has stated that he received a secret information that some persons have assembled near Sivrahiya Pool in order to commit some crime and on seeing policy party they tried to flee away but two persons were chased and apprehended by the police and three succeeded to flee away. There is recovery of country made gun with live cartridges, stolen motorcycle and
Patna High Court Cr.Misc. No.52349 of 2018(2) dt.28-09-2018 2/2 mobile from the possession of the petitioner. It has been submitted on behalf of the petitioner that petitioner is innocent and has committed no offence. He has been falsely implicated in this case due to enmity. Petitioner is a student. Nothing has been recovered from his possession and he has no criminal antecedent and he is in custody since 19.06.2018.
Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- XIV, Chapra at Saran, in connection with Garkha P.S. Case No. 249 of 2018.
