Petitioner apprehends arrest in a case registered for the offence punishable under section 379 of the Indian Penal Code and charge-sheet has been submitted under sections 392, 379, 441, 441/34 of the Indian Penal Code.

The prosecution case is that the informant was coming from his relative's house at about 9 o'clock with his motorcycle when near the Rajpur Chowk, some unknown person snatched his motorcycle.

It is submitted that the name of the petitioner has come in the confessional statement of the co-accused Bipin Kumar. He further submitted that no stolen article has been recovered from the possession of the petitioner. Petitioner has got no criminal antecedents.

In the event of arrest/surrender within a period of six weeks from today, let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, in Kesaria Police Station Case No. 238 of 2019 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
