JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 28-09-2018 Petitioner is seeking regular bail who is in judicial custody in connection with Kishanpur P.S. Case No. 190 of 2016 for the offence punishable under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the looted motorcycle has been recovered from the possession of one Indradeo Yadav. It is submitted that the petitioner has been made accused on the basis of confessional statement of the co-accused Ranjan Yadav.

No one appears for the State.

Perusal of the materials available on the record particularly the impugned order shows that the name of this petitioner has transpired in the confessional statement of Ranjan

No.52532 of 2018 (2) dt.28-09-2018 2/2 Yadav and it is in view of that confessional statement that recovery was also made from the house of Indradeo Yadav, this petitioner is allegedly involved in the loot of the motorcycle. From Paragraph No. 71 of the case diary it has come that as many as 12 cases are there against this petitioner. Learned counsel for the petitioner submits that the petitioner is on bail in all these cases, however, this Court finds that similar nature of cases are there against the petitioner right from the year 2013, this Court is not inclined to grant regular bail to the petitioner.

The application is dismissed.
