The petitioner apprehend his arrest in connection with Khushrupur P.S. Case No.30 of 2022, registered for the offence punishable under Sections 302, 201 and 34 of the Indian Penal Code and section 27 of Arms Act.
The allegation against the petitioner is that he is involved in the murder of the mother of the informant by slitting her neck. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and have committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. He further submits that similarly situated co-accused has been granted anticipatory bail by a co-ordinate Bench of this Court
Patna High Court CR. MISC. No.1210 of 2023(3) dt.04-05-2023 2/2 vide order dated 28.03.2023 passed in Cr. Misc. No.3444 of 2023. Petitioner has no criminal antecedent.
Learned APP for the State opposed the prayer for anticipatory bail and submits that the bail application of coaccused Guddu Paswan has been rejected by this Court vide order dated 17.04.2023, passed in Cr. Misc. No.52266 of 2022 and petitioner is the son of co-accused Shyam Deo Paswan in whose house the dead body of the informant's mother was found. Having regard to the facts and circumstances of the case as well as considering the nature of offence, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected.
This application is accordingly, dismissed.
