The petitioner seeks bail in Muffassil P.S. Case No. 317/2018, registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and section 30(a) of Bihar Prohibition & Excise Act.

Allegation is recovery of 36 litres of Nepali Sofia liquour from a bag recovered from the motorcycle of the petitioner.

It has been submitted that petitioner has falsely been implicated in the case. Petitioner is not the owner of the said motorcycle. The motorcycle belongs to one Rajan Kumar who fled away from the place of occurrence.

He is in custody since 07.06.2018 Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional District & Sessions Judge 7th -cum-Special Judge, Excise, East Champaran Motihari in connection with Muffassil P.S.
