====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 10-04-2023 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner has filed the present Cr. Writ Petition seeking direction from the Court to conclude the enquiry/ investigation in connection with Bettiah Town P.S. Case No. 296 of 2021 lodged under Sections 420, 379 of the I.P.C. dated 07.05.2020 for fraudulently withdrawal of Rs.2,50,000/- from the account of petitioner and to direct the respondent-Bank authorities to restore the aforesaid amount (Rs.2,50,000/-) in

Patna High Court CR. WJC No.47 of 2023(2) dt.10-04-2023 2/2 account of petitioner alongwith upto date interest. After some argument learned counsel for the petitioner seeks to refer this case with liberty to represent himself before the Superintendent of Police, West Champaran at Bettiah in the light of judgment passed in the case of Surendra Singh Vs. State of Bihar and others on 09.09.2022 in Cr.W.J.C. No. 153 of 2017 with analogous cases. Permission granted.

In this view of the matter, petitioner is directed to file a representation before Superintendent of Police, West Champaran at Bettiah in the light of order passed in the case of Surendra Singh Vs. State of Bihar and others in Cr. W.J.C. No. 153 of 2017 with analogous cases within four weeks from the date of passing of this order.

The Superintendent of Police, West Champaran at Bettiah is directed to take necessary steps for completion of fair investigation at the earliest.

With the aforesaid direction, the present Cr. Writ Petition is hereby disposed off.
