2. The petitioners seek bail in connection with Gaya Rail P.S. case No. 259 of 2023 instituted for the offences under Sections 401 and 414 of the Indian Penal Code.

3. Prosecution story, in short, is that at railway station, three persons, including these petitioners, started fleeing away on seeing the police, but they were apprehended by the police and total six mobile phones were recovered from them.

4. It has been submitted on behalf of the petitioners that the petitioners are in custody since 03.09.2023 and have no criminal antecedent. Charge-sheet has been submitted in this

Patna High Court CR. MISC. No.78255 of 2023(2) dt.05-12-2023 2/2 case. The petitioners have falsely been implicated in the present case. No specific overt act is alleged against these petitioners and submitted that both the petitioners are student.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners.

6. Considering the aforesaid facts and circumstances of the case and the fact that the petitioners are student having no criminal history, and the period of custody undergone by the petitioners, this Court is inclined to grant bail to the petitioners.

7. Let the petitioners be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Gaya Rail P.S. case No. 259 of 2023.
