JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Nawada Town P.S. Case No. 891 of 2019 registered for the offences punishable under Sections 341, 323, 307, 354B, 379 of the Indian Penal Code and Section 27 of the Arms Act.

As per FIR petitioner is said to have assaulted by means of dagger on the scalp of son of the informant and there is allegation of firing also against him.

Submission of learned counsel for the petitioner is that there is case and counter case between the parties and as per his instruction the injury is simple in nature. Heard learned APP, who has opposed the prayer for anticipatory bail stating that there is stab injury on the scalp of the son of the informant caused by this petitioner.

Patna High Court CR. MISC. No.69557 of 2019(2) dt.06-11-2019 2/2 In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, if petitioner surrenders and prays for regular bail, the same shall be considered on the basis of nature of injury sustained by son of informant.

This application is, accordingly, dismissed.
