Petitioner seeks bail in a case registered for the offences punishable under Sections 364,376(2)(G),307 and 120B of the Indian Penal Code and 27 of Arms Act. The petitioner is not named in the FIR.

According to FIR, the informant was in love with one Karan Paswan, a co-villager. The petitioner took the informant on the pretext of illness of Karan Paswan and handed over her to one Srinath Ram and three others and left them. Srinath Ram and others committed rape against her. Thereafter, they fired at her causing injury at the ankle. She further alleges that the parents are also involved in the occurrence. Submission is that false case has been lodged

Patna High Court Cr.Misc. No.51084 of 2018 (2) dt.31-08-2018 2/2 due to some dispute in the family regarding affairs of the informant with Karan Paswan. Other allegations are concocted one. Moreover, there is no such allegation against the petitioner.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Dumraon Police Station Case No.240 of 2017, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
