Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in Khaira P. S. Case No. 205 of 2016 instituted for the offence under Section(s) 366A/34 and 376 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that occurrence is alleged to have been taken place on 5.3.2016 and the complaint has been filed on 8.7.2016. The complaint was sent to the police station u/s 156(3) Cr.P.C. Thereafter, the instant case has been registered.

In the complaint petition informant has alleged that

Patna High Court Cr.Misc. No.53397 of 2018(3) dt.03-10-2018 2/2 his daughter has been kidnapped by this petitioner and other accused persons. The victim has given her statement u/s 164 Cr. P.C., wherein, she has not levelled any allegation of committing illegal act against this petitioner. It further appears from the statement of the victim girl that she went with this petitioner and lived with him for four months.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Fast Track Court 1st Jamui, in connection with Khaira P. S. Case No. 205 of 2016, Sessions Trial no. 24/2018 subject to the condition that both the bailers shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
