The petitioner seeks bail in connection with Laheriasarai Police Station Case No. 174 of 2019, registered for the offences punishable under Sections 420/406/379 of the Indian Penal Code.

The prosecution story, as per the First Information Report, is that on 06.05.2019, one person, claiming himself to be a Sadhu, was brought to the Police Station by some villagers with allegation that he was indulged in thagi of the innocent people and the informant, incidentally, arrived at the Police Station and alleged that some day before, the same person had arrived at her house and duped a sum of Rs. 10,000/- and some golden ornaments from the informant in the garb of doubling

Learned Counsel for the petitioner submits that the petitioner has got no criminal antecedent and has falsely been implicated by the police in the present case inasmuch as from perusal of the First Information Report itself, it would be evident that the informant had not lodged any complaint earlier and when the petitioner was allegedly brought by some villagers to the Police Station, she has lodged the present First Information Report. He further submits that the persons, who had brought he petitioner to the Police Station, has not lodged any complaint against the petitioner. He further submits that the petitioner is in judicial custody since 07.05.2019. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the persons, who had brought he petitioner to the Police Station, has not lodged any complaint against the petitioner and the petitioner is in judicial custody since 07.05.2019, I am inclined to enlarge the petitioner on bail.

This application is, accordingly, allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of
