JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

It has been alleged by the informant, a police official, that after getting confidential information regarding presence of anti-social elements at the Basa of Ganesh Mandal and Bhuneshwar Mandal, a raid was conducted and during course thereof, four miscreants came out, out of whom, two namely Kailash Mandal, Mihik Lal Yadav were apprehended and from their possession, firearms and ammunitions as per seizure list were recovered. Two miscreants were managed to escape after throwing the weapon, which were also seized. On interrogation, the apprehended accused disclosed identity of his associate as Gurudeo Mandal (Petitioner) as well as Kare Mandal, name of

Patna High Court Cr.Misc. No.54255 of 2018 (02) dt.20-09-2018 petitioner cropped up on account of extra-judicial confessional statement of a co-accused.

In the aforesaid facts and circumstances of the case, the learned lower Court is expected to consider the factual aspect and will pass appropriate order, more particularly in the background of the fact that petitioner has got no criminal antecedent as disclosed under Para-3 of the petition.
