Petitioner apprehends arrest in a case registered for the offences punishable under Sections 406, 409 and 420 of the Indian Penal Code, 1860.

It is alleged that petitioner has misappropriated government money of Rs. 1,30,574/-.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He next submits that petitioner had utilised the entire fund for construction. The work has already been completed and entry of same was also made in the Measurement Book for which the petitioner has also been issued a Completion cum No Objection Certificate from the District Project Officer, copy of

Patna High Court CR. MISC. No.4228 of 2023(2) dt.17-04-2023 2/2 which has been annexed as Annexure-3 to this application. Considering the fact that work has already been completed, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Patna City in connection with Khusrupur P. S. Case No. 117 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
