The petitioner is apprehending arrest in connection with Complaint Case No. 851C of 2018 for offences under Sections 323 and 406 IPC.

Allegation against the petitioner is that he betrayed the informant in the matter of transfer of 33 decimals of land.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. After 27 years of the alleged transfer now the informant, in order to grab some valuable land of the petitioner, has filed the present complaint

Patna High Court CR. MISC. No.70338 of 2019(3) dt.05-03-2020 2/2 case. After execution of the sale deed the land was mutated in the name of the informant. Now after 27 years he wanted the land mutated, to be changed by another valuable land of the petitioner in place of the earlier land registered. Considering the fact that petitioner has no criminal antecedent and the case was registered after 27 years of the alleged transfer, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the ACJM-V, Araria in connection with Complaint Case No. 851C of 2018, subject to the conditions as laid down under Section 438(2) Cr. P. C.
