JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Goh P.S. Case No. 14 of 2019 registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

As per FIR petitioner has taken a loan of Rs.8 lac from the informant on the plea of marriage of his daughter and thereafter he has given three cheques of total amount of Rs.5 lac and on production the same dishonored due to insufficient of money.

Submission of learned counsel for the petitioner is that he is still ready to pay the above amount of Rs.5 lac if some reasonable time is allowed to him.

In view of above facts and circumstances, this application is disposed of with direction to the petitioner to surrender within a period of six weeks from the receipt of this order along with a Bank Draft of Rs.1 lac in favour of the informant and on deposit of the same he shall be released on provisional bail by the court below for a further period of four months and during that period petitioner has to deposit rest of the amount in four equal instalments through Bank Draft in favour of informant and once the total amount of Rs.5 lac is deposited, the court below shall confirm the bail bonds of the petitioner. Failure to deposit continuously two instalments, his bail bonds shall be cancelled. It is made clear that once the total amount is deposited, on filing an application by the informant, the amount shall be released in his favour.
