The petitioner is languishing in custody since 27.08.2019 in a case registered for the offence punishable under Section 392 of the IPC.

The prosecution case is that the mobile phones of the informant and his driver and cash amount of Rs. 22,700/- were robbed by three unknown persons, leading to registration of FIR against three unknown persons. It is alleged that during investigation, one of the robbed mobile phones, was recovered from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has not been put on T.I. Parade till date and the petitioner was using the alleged mobile phone bona fidely

A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that one of the robbed mobile phone has been recovered from the possession of the petitioner. Considering the nature of recovery, period under custody, the petitioner not being put on T.I. Parade till date and the investigation already being concluded, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned JM, 1st Class, Gopalganj in connection with Biakunthpur P.S.
