This is an application for regular bail in connection with N.D.P.S. Case No. 30 of 2017 arising out of Ara Town P.S. Case No. 424 of 2017 registered for the offences punishable under Sections 21(b) of the Narcotic Drugs and Psychotropic Substance Act, 1985.
Allegation against petitioner is of recovery of 45 gram brown colour narcotic Substance (Heroin) from the possession of petitioner.
It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case. Petitioner is a student. Other similarly placed co-accused persons, namely, Tarun Kumar and Rakesh Kumar have been
Patna High Court Cr.Misc. No.51729 of 2018(2) dt.28-09-2018 2/2 granted bail by this Hon'ble Court passed in Cr. Misc. 28120 of 2018 vide order dated 10.05.2018 and Cr. Misc. No. 12918 of 2018 vide order dated 13.08.2018 respectively. Petitioner has no criminal antecedent and he is in custody since 14.08.2017. Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Bhojpur at Ara, in connection with N.D.P.S Case No. 30 of 2017 arising out of Ara Town P.S.
